Msibi to appeal his suspension from the ANC

Mpumalanga ANC treasurer, Mandla Msibi, has changed his mind to appeal his three-year suspension.

The ANC’s Provincial Disciplinary Committee (PDC) suspended Msibi for three years with two years suspended on allegations of trying to disrupt the party’s January 8 celebrations.

He was accused of badmouthing President Cyril Ramaphosa about the delay in the construction of the R9 billion Nkosi City on the outskirts of Pienaar, west of the Kruger National Park and about 45km east of Mbombela.

Msibi conceptualised  the Nkosi City project with local chief Sicelo Nkosi and property developer Philip Kleijnhans 15 years when he was a ward councillor in the City of Mbombela. The modern agri-city will be situated on a 959-hectare farm and it has  2 358 stands. The project is expected to benefit 123 000 households and create 15 000 jobs.

Msibi had, earlier in the week, said that he was not going to appeal his suspension on April 9. His allies had however indicated he could even resign from the ANC.

Msibi is also the MEC for Cooperative Governance and Traditional Affairs. His spokesperson, Uhuru Mofokeng, said that Msibi decided to appeal following thorough examination.

“After thoroughly examining the judgment as presented by the provincial executive committee (PEC) of the ANC on behalf of the PDC, juxtaposing the management and handling of the whole disciplinary process by both the PEC and PDC, the flawed and misconstrued, interpretation and implementation of various clauses of rule 25 of the Constitution of the ANC, the provincial treasurer, Cde Mandla Msibi has decided and already initiated the process of appealing the decision by the PDC to the National Disciplinary Committee,” Mofokeng said.

“[He] initiates the process of appealing the decision taken against him by the PDC on the 9th of April 2024, a decision which seeks to put to a halt the active status of the membership of Cde Mandla Msibi, albeit for three years, with two years suspended,” he added.

Mofokeng said that the appeal meant that that no action shall be taken any further until the appeal process has been duly concluded.

Msibi is number 17 on the province-to-province list, which means he would still be guaranteed a legislature position after the May 29 elections if he did not return into cabinet.

Since he became a PEC member and MEC, Msibi has been fighting for political survival.

A few years ago, he faced about 30 charges of assault, attempted murder and vandalism which were all dismissed due to lack of evidence.

After a short respite, Msibi was charged with double murder and two attempted murder charges following a shooting incident outside Coyotes Shisa Nyama in Mbombela.

A conflict about local government list conference is believed to have precipitated this and other violent incidents in the province, particularly in Barberton.

Msibi was eventually acquitted and had to be appointed back into cabinet and occupy his ANC position after he stepped aside.
